Pacify Technologies, LLC ("Pacify," "us," "we," or "our") operates application programming interfaces ("APIs"), web applications, and websites. This Privacy Policy applies to all Pacify APIs, web applications, and websites (collectively, the "Services").

We collect and use your information to provide our Services to you, improve our Services, and inform you about updates to our Services. Our goal is to make our Services as simple as possible while protecting your personal information. We create our Products and Services for enterprise customers and try to limit the collection of personal data to your first and last names. We share your information with third-party service providers, including payment providers, but only to the extent necessary to provide our Services to you. We do not sell your information to third parties for advertising purposes. Our Services may also integrate with third-party service providers' APIs to limit the data stored on our servers. This Privacy Policy ("Policy") describes how we collect, use, and disclose your data when you use our Services and the choices you have associated with that data. Please review this Policy carefully.

By using our Services, you agree to us collecting and using your information per this Policy. Unless otherwise defined in this Policy, the terms used in this Policy have the same meanings as in our Terms of Service.

Types of Data We Collect

Consumer Data

We may collect certain information automatically whenever you visit our Services, contact us, or sign up for our newsletter ("Consumer Data").

Consumer Data may include the device you use to access our Services, operating system, IP address, browser type, email client, demographic data, website pages you visit, any information you provide when you contact us, and other diagnostic data.

We will treat your communications, including questions, suggestions, or concerns that do not pertain to your personal data, as non-confidential and non-proprietary. We will request your permission before posting testimonials about our Products and Services on our websites.

Customer Data

While evaluating or using our Products, we or a third-party service provider may ask you to provide certain personally identifiable information and other data to open or update an account, contact you, or identify you ("Customer Data"). Customer Data may include, but is not limited to:

  • First name and last name
  • Company email address
  • Company phone number
  • Company address
  • Company credit card or other payment information
  • Employer Identification Number (EIN)
  • Login name and password
  • Purchase history
  • Signature
  • Your preferences or settings

We also collect details related to your use of our Products, including but not limited to when you request Data through our Products and when we provide the Data.  

We will share information about you and requested Purchases with other parties who help to facilitate the Purchases.

Tracking Data

Pacify does not currently use cookies. But third-party services incorporated into our Services may use cookies and similar tracking technologies to collect certain information and to personalize your experience with our Services. Cookies are files with a small amount of data sent to your browser from a website and stored on your device. Third-party services may use cookies to make our Services easier by remembering your preferences or default options. You can request your browser to refuse all cookies or to indicate when websites send cookies. 

The marketing and non-marketing emails we send through Mailchimp use web beacons. These web beacons track whether the email sent through the Service was delivered and opened and whether you clicked links within the email. We use this information to measure and improve the effectiveness of our emails.

Our websites may include web analytics tools such as Google Analytics which tracks page views and visitor data such as device type, operating system, and browser type. Web analytics tools may also collect demographic data such as age, gender, location, and language. We use the aggregate information to evaluate the quality of our websites.

Use of Data

Pacify may use the collected data for various purposes including, but not limited to:

  • Verify your identity and eligibility to use our Products
  • Create your account and grant access to our Products
  • Enable features to personalize your account
  • Execute Product-level Agreements and other contracts
  • Provide invoices
  • Process or facilitate payments
  • Provide Data and Services to you
  • Monitor and analyze usage within Services
  • Send newsletters and other promotional information and track their effectiveness
  • To notify you about changes and updates to our Services
  • Conduct data analysis and testing to improve our Services
  • Solicit feedback
  • Manage our everyday business needs, such as complying with the law
  • To detect and address technical issues
  • Maintain the safety, security, and integrity of consumers and our Services
  • Identify and prevent detrimental behavior on the platform
  • Improve the content and functionality of the Services
  • Respond to your questions and assist with any problems
  • Resolve claims or disputes

Pacify uses the services of Mailchimp for our email marketing. You can view their privacy policy at intuit.com/privacy/statement/. By creating an Account on our Services or subscribing to our newsletter, you agree to receive updates and other promotional information we may send via email. However, you may opt out of receiving these communications by following the instructions in the email or contacting us. You may not, however, unsubscribe from non-marketing communications such as legal notices. These notifications are necessary for using the Services and cannot be disabled. However, you may be able to adjust how you receive these notifications.

Pacify uses the services of Zoho Desk to provide you with better customer service and support. You may view Zoho's privacy policy at zoho.com/privacy. We may direct your written and verbal communications to the Zoho platform, where our support team will review and address your inquiries. We recommend you avoid submitting sensitive information to help us protect your personal information.

Transfer of Data

Your information, including personal data, may be transferred to — and maintained on — computers and servers outside of Pacify and your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. We may store your information on the servers of third-party cloud storage providers. Your submission of such information represents your agreement to the transfer. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and process it here.

Pacify will take reasonable steps to verify the security of your data and to validate that data transfers are to organizations and countries with adequate controls.

Disclosure of Data

To Third Parties

 To promote the quality of our Services, we may share your information, including contact information and personal data, with third parties that provide services to us. We expect the third parties to provide the same level of protection of your information as we do, per this Policy. Third parties with access to your Personal data perform specific tasks on our behalf. We may share information provided by you or information automatically collected through our Services. We may share the information directly or through an API or other application that integrates with our Services to deliver a service to you.  Third-party service providers may include, but are not limited to:

  • Payment processors
  • Cloud storage providers
  • IT and data security vendors
  • Professionals such as lawyers and accountants
  • Data processing and analytics vendors
  • Help desk software providers
  • Email and phone service providers
  • Email marketing and communications vendors
  • Invoice providers
  • Electronic signature services
For Business Transaction

If Pacify is involved in or negotiating a merger, acquisition, or asset sale, we may transfer your Data to one or more third parties as part of that transaction.

When Required by Law

Under certain circumstances, Pacify may be required to disclose your personal data if required by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Pacify may also disclose your personal data if it believes in good faith that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of Pacify Technologies, LLC
  • To prevent or investigate possible wrongdoing in connection with the Services
  • To protect the personal safety and property of users of the Services or the public

Payments

We use third-party services for payment processing. We will not generally store or collect your credit card details or other payment information. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their privacy policy. The payment processors' web applications may make the expiry date and the last four digits of the credit card number available to us. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council. PCI-DSS requirements help ensure the secure handling of payment information. Our Services may contain links to other sites that we do not operate. Clicking on the links will direct you to that third party's site. We strongly advise you to review every site's privacy policy. We have no control over and assume no responsibility for third-party sites or services' content, privacy policies, or practices.

Children’s Privacy

Our Services are not for children under 18, and we do not knowingly collect personally identifiable information from anyone under 18. We will take steps to remove any information from our servers if we unintentionally collect the personally identifiable information of minors.

Security of Data

We implement administrative, technical & physical safeguards to protect your information. Pacify limits access to your personal information to employees needing it to perform their duties. While we strive to use commercially acceptable means to protect your personal data, please note that no method of transmission over the internet or method of electronic storage is 100% secure. Please remember this when disclosing personal data or other information to Pacify. You are responsible for safeguarding your username, password, and API keys.

Data Retention

You may request to delete your account from our Services by emailing us at support@pacifytech.com. To help us protect your personal information, we recommend that you don't include sensitive data in the email. We may temporarily retain personal information about you even after we delete your account from our Services, as our servers may have backup copies of such information. We may also keep records relating to your past Purchases for financial reporting and compliance purposes. We may retain and use your personal information as necessary to meet our legal obligations, resolve disputes, enforce our agreements, or for legitimate business purposes, such as fraud prevention and promoting the safety and security of our platform.  We may retain non-personal data or aggregated data indefinitely.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any change by posting the new Privacy Policy on this page. If there are significant changes to how we use or disclose your personal information, we will inform you via email or a prominent notice on our Services. We will also update the 'Effective Date' at the top of this Privacy Policy.  If you object to any changes, you should cease using our Services. Your continued use of our Services after any change to this Privacy Policy indicates your consent to the revised Privacy Policy.

You should review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when posted on this page.
